What is the procedure for a pilgrim prevented from Hajj according to Malik?
Chapter on What the Muhrim Must Avoid and What is Permissible for Him
Al-Mughni
Book of Hajj
Primary text
Imam Malik mandates that the prevented pilgrim must proceed to the boundary (*Hill*) and perform the rites that a pilgrim performing 'Umrah performs. If he wishes to appoint a representative (*nab*) to complete the rites of Hajj on his behalf, this is permissible for a voluntary (Nafl) Hajj because appointing a deputy was permitted for the entirety of Hajj, making it permissible for a part thereof. It is not permissible for the obligatory Hajj unless the pilgrim despairs of ever being able to perform it entirely during his lifetime, mirroring the ruling for missing the entire obligatory Hajj.
