What is the required compensation for damaging trees in the Haram?
Chapter on What the Muhrim Must Avoid and What is Permissible for Him
Al-Mughni
Book of Hajj
Primary text
The compensation for a large tree (Dauhah) is a cow (Baqara), and for a small tree (Jazalah) is a sheep (Shāh). Vegetation (Hashish) requires compensation according to its market value, and a broken branch requires compensation for the resulting diminution in its value. This specific quantification is supported by Al-Shafi'i.
Supporting text
The Ashab al-Ra'y mandate that compensation for everything must be based on its market value because there is no fixed prescribed amount (Taqdir), making it similar to vegetation.
