What is the required expiation if a pilgrim performing Qiran invalidates their rites through sexual intercourse?
Chapter on the Description of Hajj
Al-Mughni
Book of Hajj
Primary text
If a pilgrim performing Qiran invalidates their rites through sexual intercourse, only one expiation (fidyah) is required. This view is held by Atta, Ibn Jurayj, Malik, Shafi'i, Ishaq, and Abu Thawr. The blood sacrifice associated with Qiran is not dropped. The basis for this is that the Companions, when asked about someone who invalidated their rites, commanded only a single expiation without distinction. Furthermore, since Qiran is one of the three types of pilgrimage, its invalidation should not necessitate more than one expiation, similar to the other types and other prohibitions of Ihram (like wearing clothes or using perfume), which each require only one expiation, akin to the case of a pilgrim performing Ifrad (single Hajj).

Al-Hakam stated that two sacrifices are required. A view derivable from the school suggests a camel (badanah) and a sheep (shat) are required if one posits that two circumambulations (tawafan) are obligatory. The People of Opinion (Ahl al-Ra'y) stated that if intercourse occurs before the standing at Arafah, the pilgrimage is voided, and two sheep are due for the Hajj and Umrah, dropping the Qiran sacrifice.
