What is the required expiation if the woman was coerced (Makrahah) into sexual intercourse while in Ihram?
Chapter on What the Muhrim Must Avoid and What is Permissible for Him
Al-Mughni
Book of Hajj
Primary text
If the woman was coerced into intercourse, no Hady (sacrifice) is required of her, nor is the man required to offer a Hady on her behalf. This is based on the statement of Ahmad, as it is intercourse necessitating expiation, and in the case of coercion, only one expiation is required, similar to fasting. This view is held by Ishaq, Abu Thawr, and Ibn al-Mundhir.
Supporting text
There is a second narration from Ahmad stating that the man must offer a Hady for her, supported by 'Ata' and Malik, because the invalidation of Hajj occurred in his regard, thus he owes a Hady for invalidating her Hajj, analogous to his own Hajj. Another possibility derived from Ahmad's statement suggests the Hady is due from her, which the husband pays on her behalf, meaning it is not a third distinct ruling.
