What is the required expiation if the woman willingly participated (Mutawi'ah) in sexual intercourse while in Ihram?
Chapter on What the Muhrim Must Avoid and What is Permissible for Him
Al-Mughni
Book of Hajj
Primary text
If the woman willingly participates, a camel (Badanah) is due from each of them. This is the view of Ibn Abbas, Sa'id ibn al-Musayyib, Al-Nakha'i, Al-Dahhak, Malik, Al-Hakam, and Hammad, based on Ibn Abbas stating, 'She should sacrifice a she-camel, and she should sacrifice a she-camel.' This is because she is one of the two parties engaging in intercourse without coercion, thus making a Badanah incumbent upon her just as it is upon the man.
Supporting text
A narration from Ahmad expresses hope that a single Hady suffices for both of them, a view held by 'Ata' and the school of Al-Shafi'i. This is because it is a single act of intercourse, which should not mandate more than one Badanah, similar to the coerced situation. A sleeping woman is treated like one who is coerced in this specific regard.
