What is the ruling concerning one obligated to fast (due to Hajj Tamattu) who is unable to perform the required Hady (sacrifice) until after the prescribed time for fasting?
Chapter on the Description of Hajj
Al-Mughni
Book of Hajj
Primary text
There are two narrations regarding one obligated to fast (due to Tamattu) who lacked the means for the Hady sacrifice until after the time for fasting elapsed. In one narration, the obligation to fast remains established against him, and he should fast upon returning home. The obligation shifted to fasting because fasting was established in his liability due to the existence of the connected prerequisite, which is the inability to offer the Hady. This view is reported by Al-Marwazi.

The second narration dictates that he is obligated to transition to the Hady sacrifice. Imam Ahmad, when questioned about the Mutamatti who did not fast before the Day of Sacrifice (Yawm an-Nahr), stated that he owes two Hady sacrifices: the original Hady due to Tamattu, and a second Hady for delaying the fast beyond its prescribed time. The justification is that he acquired the means for the substitute (Hady) before commencing the principal substitute (fasting), thus mandating the transition back to the Hady, similar to a person performing Tayammum who subsequently finds water.
