Does the ruling on dissolution due to restriction apply equally to Hajj, Umrah, or both forms of Ihram?
Chapter on What the Muhrim Must Avoid and What is Permissible for Him
Al-Mughni
Book of Hajj
Primary text
The permission to dissolve the Ihram applies whether the initial state was consecrated for Hajj, Umrah, or both concurrently. This is the established position of our Imam (presumably Abu Hanifa, given the context), Abu Hanifa, and Al-Shafi'i. The evidence rests on the historical context of the revelation of the verse concerning Al-Hudaybiyyah, where the Prophet and his Companions were performing Umrah and subsequently dissolved their state.
Supporting text
It is narrated from Malik that the one performing Umrah does not dissolve the Ihram because the concern of missing the prescribed time (Fawat) does not apply. This opinion is rejected because the verse was revealed regarding the restriction at Al-Hudaybiyyah, where the Companions performing Umrah were permitted to dissolve their state.
