What is the ruling if the Hady is given intact to the poor, and they fail to slaughter it?
Chapter on Ransom (Fidyah) and Penalty for Hunting
Al-Mughni
Book of Hajj
Primary text
If the animal is given intact to the poor, and they fail to perform the prescribed slaughter or necking, the offerer is obligated to reclaim it and perform the necessary ritual slaughter. If he fails to reclaim it or is unable to do so, he becomes liable for its compensation (guarantee/warrant), due to his negligence in handing it over to them while it was still intact, thereby causing the ritual sacrifice to be missed.
