If one omits the overnight stay in Mina, there is no penalty incumbent upon him, though he has acted improperly. This is the view of the companions of al-Ra'y (followers of Abu Hanifa), as the legal texts contain no specific decree regarding it. Alternatively, some suggest he must feed the poor (Tathawub). The definitive position is that one must give a small amount of charity, such as dates or similar items, and this applies equally to missing one night or more, with no specific measure required for the charity.

A narration from Ahmad suggests that leaving it requires the offering of a sacrificial animal (Dam). Ibrahim stated that omitting it requires a Dam, though later he emphasized giving charity instead. Another narration from Ahmad mandates a Dam for missing three nights.
