What is the ruling if the order of the acts on the Day of Sacrifice is violated due to forgetfulness or ignorance?
Chapter on the Description of Hajj
Al-Mughni
Book of Hajj
Primary text
If one deviates from the prescribed order, whether through forgetfulness or ignorance of the Sunnah concerning the order, there is no penalty upon that person. This is the opinion held by many scholars, including Al-Hasan, Tawus, Mujahid, Sa'id ibn Jubayr, 'Ata', Ash-Shafi'i, Ishaq, Abu Thawr, Dawud, and Muhammad ibn Jarir at-Tabari. The evidence for this is the Prophet's response to those who inquired after transgressing the order, such as when a man said he shaved before sacrificing, and the Prophet commanded, 'Sacrifice, and there is no blame.' Similarly, when asked about sacrificing before stoning, he commanded, 'Stone, and there is no blame.' Furthermore, when asked generally about precedence and delay on the Day of Sacrifice, he replied, 'Do it and there is no blame upon you.'

Abu Hanifah ruled that if one places the shaving before the stoning or before the sacrifice, a blood sacrifice (dam) is due. If one is performing Qiran Hajj, two blood sacrifices are due. Zufar held that three blood sacrifices are due because the first state of exiting Ihram has not been achieved, necessitating a blood sacrifice as if the shaving occurred before the permissible time.
