What is the ruling if the order of the acts on the Day of Sacrifice is violated intentionally?
Chapter on the Description of Hajj
Al-Mughni
Book of Hajj
Primary text
There are two transmitted narrations regarding intentional violation of the order. The first view holds that no blood sacrifice is due, which is the position of 'Ata' and Ishaq, due to the general nature of the Hadith of Ibn 'Abbas and the narration of Ibn 'Uyaynah from Abdullah ibn 'Amr's report. The second view mandates a blood sacrifice. This latter view is related from Sa'id ibn Jubayr, Jabir ibn Zayd, Qatadah, and An-Nakh'i, and it is supported by the Quranic verse, 'And do not shave your heads until the Hady reaches its prescribed place,' and the Prophet's command, 'Take your rites from me,' implying adherence to the established order, thereby preferring the specific prohibition over the general permission.

It is noted that the ruling of exemption from the blood sacrifice when a required act is missed at its time does not necessarily imply exemption if the act is performed before its designated time. Malik's view states that if shaving precedes stoning, a blood sacrifice is due, but if shaving precedes sacrifice, or sacrifice precedes stoning, there is no penalty, because the first exit from Ihram is only achieved by stoning the Jamrah, whereas sacrifice before stoning is permissible since the Hady has reached its designated time.
