Primary text

If wealth is found but a deputy for Hajj cannot be found, the ruling depends on whether the ability to travel (al-Maseer) is a condition for the obligation of Hajj (Wujub) or a condition for its necessity to be performed immediately (Luzum al-Sa'i). If the ability to travel is deemed a condition for the necessity of performance, then Hajj remains an obligation upon the person's estate, and someone should perform Hajj on their behalf after their death.

Supporting text

If the ability to travel is considered a condition for the obligation (Wujub) itself, then nothing is obligatory upon them.
