Primary text

When a person performing Qiran misses the Hajj rites, they are considered unbound (*hall*) from their ritual state. They must perform the Hajj again the following year, offering the same type of offering (*ihram*) they initially intended for the Qiran. This is the established position of Ahmad, Malik, Shafi'i, Abu Thawr, and Ishaq. The justification is that the subsequent Hajj must match the initial performance in form and meaning, thus necessitating both the offering (*hady*) for the initial Qiran and the offering for missing the Hajj. Malik and Shafi'i hold this view regarding the requirement of two offerings.

Supporting text

It is inferred that what they have performed suffices for the obligatory 'Umrah of Islam, and only the makeup Hajj is required because nothing else was missed. Furthermore, some scholars suggest a third offering is required for the makeup Hajj, but this view is rejected because the makeup Hajj itself does not necessitate an offering; the offering is only due for the missed Hajj due to non-completion, and the Companions did not command more than one offering.
