If an individual holds a debt owed by a solvent debtor who is willing to pay, and the amount suffices for Hajj, then performing Hajj becomes obligatory upon the creditor because he is capable.

Supporting text

If the debt is owed by an insolvent person, or if recovering the debt is impossible, Hajj is not obligatory upon the creditor.
