Is the ruling on sexual intercourse before four circuits of Tawaf different from that after four circuits of Tawaf?
Chapter on the Description of Hajj
Al-Mughni
Book of Hajj
Primary text
Sexual intercourse is treated uniformly regardless of whether it occurs before or after completing four circuits of Tawaf, as intercourse is one of the prohibitions (Mahdhurat) of Ihram. The violation invalidates the complete state of Ihram, just as it does before completing the Tawaf.
Supporting text
Abu Hanifa distinguishes the ruling based on the completion of four circuits of Tawaf. If intercourse occurs after completing four circuits, only a sheep is required, and the Umrah remains valid.
