What is the ruling for those who delay stoning (ramy) until night?

The ruling applies to the shepherds ('Ru'ah') and those responsible for watering the pilgrims ('Ahl al-Siqayah'). They are permitted to perform the stoning rituals at night because they are occupied during the day with tending and guarding livestock, or with providing water from the well of Zamzam to the pilgrims. This allowance is a facilitation for them. They may perform the stoning for each day in the subsequent night. Specifically, they stone Jamrat al-Aqabah on the night of the first day of Tashreeq, the stoning of the first day on the night of the second, and the stoning of the second day on the night of the third. If they postpone the stoning of the third day until after sunset, the obligation is waived for them, just as it is waived for others.

Ata stated that only the camel herders ('Ru'ah al-Ibil') are permitted to stone at night; traders are not permitted this concession. Malik, Al-Shafi'i, Abu Thawr, and the Ashab al-Ra'y held that whoever forgets the stoning until nightfall may perform it without penalty, whether they are shepherds or not.
