The apparent ruling suggests that wearing a *Qaba'* is permissible as long as the hands are not inserted into the sleeves. This is the position of Al-Hasan, Ata, Ibrahim, and Abu Hanifa. The justification is that the garment does not fully encircle the body when only draped over the shoulders, thus not incurring the penalty, similar to draping a shirt (*Qamis*) without inserting the arms.

Al-Qadi and Abu al-Khattab hold that if the shoulders are placed into the *Qaba'*, expiation is due even if the hands are not inserted into the sleeves, following the view of Malik and Al-Shafi'i, as it is a sewn garment worn customarily. This is supported by the narration that the Prophet, peace be upon him, forbade wearing *Aqbiya* (plural of *Qaba'*).
