Is the standing at Arafat valid if performed while one is unconscious or asleep?

Chapter on the Description of Hajj

Al-Mughni

Book of Hajj

Book 11 · Issue 3 · Bab 5

Open in Qurani

Primary text

If one stands while asleep, the standing is valid because the sleeper is considered in the legal status of one who is awake. This is considered analogous to spending the night at Muzdalifah.

Supporting text

Regarding one who is unconscious, Ahmad ibn Hanbal expressed hesitation, noting that Al-Hasan invalidated the Hajj while 'Ata permitted it, due to the lack of intention (niyyah) or ritual purity (tahara) being considered necessary. Those invalidating it argue that since it is a pillar of Hajj, it cannot be valid from an unconscious person, just like other essential pillars. Ibn 'Aqil equates a drunk person with an unconscious person because both lack sanity through a cause other than sleep.
