Is there liability (Jaza') for hunting game in the sacred precincts (Haram) if the projectile was launched from outside (Hill)?
Chapter on What the Muhrim Must Avoid and What is Permissible for Him
Al-Mughni
Book of Hajj
Primary text
Liability (Jaza') is obligatory when one shoots game from the precincts of lawful hunting (Hill) and it kills game within the sacred precinct (Haram). This is the position held by Al-Thawri, Ishaq, and the Ahl al-Ra'y (People of Opinion). The evidence is that it constitutes the killing of sacred game within the Haram, similar to throwing a stone from the Hill that kills game in the Haram. Intentionality and error are equivalent regarding the obligation of Jaza' in this context.
