Validity of Hajj or Umrah performed by an agent when commanded to perform both (Qiran)?
General Chapter
Al-Mughni
Book of Hajj
Primary text
If the principal commands the agent to perform Qiran (combining Hajj and Umrah) and the agent performs only one (either Hajj or Umrah), the act performed is valid and counts on behalf of the principal. The principal is entitled to a refund of the expenses corresponding to the ritual (Ihram) that the agent did not undertake, calculated from the starting point of Ihram (the Miqat). This ruling applies similarly if the principal commanded both acts and the agent only performed one.
Supporting text
If the principal commanded the agent to perform only one specific ritual (either Hajj alone or Umrah alone) and the agent performs it, the act is valid for the principal. In this case, the principal must refund the agent for the portion of expenses related to the ritual that was left undone, calculated from the Miqat.
