What constitutes the primary condition for Ihsan (marital status)?

The primary condition for Ihsan is penetration of the forepart (al-qablab), which is undisputed, based on the Hadith: 'The previously married woman (Thayyib) for the previously married woman: whipping and stoning.' Previous marital status is established only through penile penetration.
