What constitutes a proper enclosure (Hirz) for property within a dwelling structure?
Chapter on Amputation in Theft
Al-Mughni
Book of Ḥudūd (Prescribed Penalties)
Primary text
The wall enclosure of a dwelling is considered a proper Hirz if it is built within inhabited areas (Umran) or, if situated in the wilderness, if it has a guard. If the quantity taken from the wall's components or wood reaches the Nisab (threshold amount), amputation (Qat') is obligatory. This is because the wall serves as a Hirz for other items, thus it serves as a Hirz for itself. If the wall is demolished but nothing is taken from it, there is no amputation, similar to the case where movable property within a Hirz is damaged but not stolen.
