Is the hand cut off for stealing from the spoils of war before the Khums (one-fifth) is set aside?

If the thief is not among the initial recipients of the spoils (Ghanimin) nor among those who have a specified right mentioned previously, and they steal from the spoils before the Khums is separated, the hand is not cut off because they have a right in the Khums portion.
