Is the hand cut off for stealing a vessel specifically prepared to hold wine?
Chapter on Amputation in Theft
Al-Mughni
Book of Ḥudūd (Prescribed Penalties)
Primary text
The hand is cut off for stealing a vessel prepared to hold wine and used for that purpose. The vessel itself carries no inherent prohibition; the prohibition arises from the intention and purpose of the stealer. This is analogous to stealing a knife intended for slaughtering pigs or a sword intended for highway robbery.
