Does moving a shroud from one part of the grave (lahd) to another within the grave constitute theft from a secure enclosure requiring amputation?
Chapter on Amputation in Theft
Al-Mughni
Book of Ḥudūd (Prescribed Penalties)
Primary text
If the shroud is taken out of the side niche (lahd) and placed within the main part of the grave, there is no cutting, because the item has not been removed from the enclosure (the grave itself). This is analogous to moving goods within a house, as the Prophet, peace be upon him, referred to the grave as a house.
