Book 51 · Issue 3 · Bab 2

Open in Qurani

Primary text

If one individual removes less than the *nisab* and the other removes more, resulting in the total reaching two *nisab*, amputation is obligatory upon both according to the companions of Imam Ahmad and Abu Hanifa and his two companions. The necessity stems from the combined effort reaching the required threshold for the group.

Supporting text

Al-Shafi'i and his followers rule that amputation is not applied to the person who did not personally remove the *nisab* amount. If one removes exactly one *nisab* and the other removes less, amputation is obligatory upon both according to the companions of Imam Ahmad, upon the remover of the *nisab* alone according to Al-Shafi'i, and there is no amputation according to Abu Hanifa because the amount removed by the actual remover does not reach the *nisab* when counted relative to the number of thieves.
