Chapter on Amputation in Theft
Al-Mughni
Book of Ḥudūd (Prescribed Penalties)
Primary text
If a person confesses to stealing the threshold amount of property from two individuals, and only one confirms the theft while the other states it was unlawful seizure or denial of deposit, amputation is not applied. This view is held by the companions of the opinion (Ahl al-Ra'y).

Abu Thawr holds that if the second individual claims it was unlawful seizure (ghasabtanī), amputation is performed. The prevailing view holds that amputation is not applied because the confession did not fully align with the demand for theft involving the Nisab amount from both parties, similar to the preceding case.
