What is the ruling on amputation when two individuals break into an enclosure, and one removes the property through the opening?
Chapter on Amputation in Theft
Al-Mughni
Book of Ḥudūd (Prescribed Penalties)
Primary text
If two individuals break the enclosure (*hirz*), one enters, the property is brought near the opening, and the one outside inserts his hand to remove it, amputation is obligatory upon both, according to the deduction from the position of Imam Ahmad (as held by his companions). This is because both participated in violating the enclosure and removing the property, similar to the case where they both carry and remove it.

Al-Shafi'i rules that amputation applies only to the remover of the property. Abu Hanifa rules that there is no amputation on either of them. If the property is placed in the opening and the other extends his hand to take it, amputation is upon both. A report from Al-Shafi'i indicates two opinions in this matter, mirroring the two primary schools of thought in the preceding scenario.
