What is the ruling concerning the act of 'Tarrar' (secret theft from a pocket or sleeve)?
Chapter on Amputation in Theft
Al-Mughni
Book of Ḥudūd (Prescribed Penalties)
Primary text
The ruling is that the thief who commits 'Tarrar' (secretly stealing from a man's pocket or sleeve) is subject to 'Qat' (amputation of the hand). This applies whether the stolen item remains inside the pocket or sleeve, or if the thief cuts the pocket/sleeve to take the item, or if the thief puts their hand into the pocket and takes what is inside. Ahmad is associated with this view.
Supporting text
There is a narrated report from Ahmad stating that there is no 'Qat' upon the one who takes from a man's pocket or sleeve. Thus, there are two narrations concerning this matter.
