What is the ruling regarding the exile (taghrib) of an adulterer who is a non-native?
General Chapter
Al-Mughni
Book of Ḥudūd (Prescribed Penalties)
Primary text
The non-native adulterer must be exiled to a locality other than his homeland. If he commits adultery again in the place to which he was exiled, he must be exiled from that place to a location other than his original homeland. This ruling is based on the general applicability of the command concerning exile wherever the adulterer may be situated. Furthermore, exile serves to remove him from the place where he has become accustomed (anasa) to living.
