What is the ruling on repeated commission of the same type of offense subject to *Hadd* before implementation?
General Chapter
Al-Mughni
Book of Ḥudūd (Prescribed Penalties)
Primary text
If the prescribed punishments for adultery (*zina*), theft, slander (*qadhf*), or drinking alcohol are repeated before the first instance of the punishment is executed, a single punishment suffices. There is no known difference of opinion on this matter. Scholars who hold this view include 'Ata', Al-Zuhri, Malik, Abu Hanifa, Ahmad, Ishaq, Abu Thawr, and Abu Yusuf, and it is the position of Al-Shafi'i. If a punishment is executed, and a subsequent, different offense occurs, a separate prescribed punishment is due for the new offense, without known dispute.
