What is the ruling on slandering the child of a Mu'an'anah (a woman who engaged in mutual cursing/imprecation with her husband)?
General Chapter
Al-Mughni
Book of Ḥudūd (Prescribed Penalties)
Primary text
The Hadd is established upon the slanderer if he accuses the child of being the offspring of adultery. This is based on a narration from Ibn Abbas that the Prophet (peace be upon him) ruled regarding the Mu'an'anah that neither she nor her child should be denounced, thus necessitating the Hadd penalty for slander. This is because her inviolability (Hasanah) was not nullified by the L'ian, nor did the adultery become established against her.
Supporting text
If the slanderer says, 'He is not the son of so-and-so [referring to the cursing husband],' intending to declare him legally illegitimate, no Hadd is established because the slanderer is truthful in that legal negation.
