Is a wife subject to amputation if she takes from her husband's wealth without permission?
Chapter on Amputation in Theft
Al-Mughni
Book of Ḥudūd (Prescribed Penalties)
Primary text
Amputation is not incumbent upon a wife if her husband prevents her from taking what is sufficient for her or her children, and she takes from his wealth, whether the amount taken equals the sufficiency or exceeds it. This is because she is entitled to that portion, and any excess is considered shared property based on what she rightfully deserves to take.
