To whom does a fish belong if it enters a ship due to the deliberate actions of a fisherman?
General Chapter
Al-Mughni
Book of Hunting and Slaughter
Primary text
If the fish is secured through human action intended for hunting, such as a fisherman using light at night and drumming to attract fish into the boat, the fish belongs to the fisherman, not the person in whose lap it lands. This is analogous to a hunter throwing a bird into another person's house. If the fish enters accidentally without the intention of hunting, it belongs to the person in whose lap it falls.
