Is game permissible (halal) to eat if a stone thrown while assuming it was game strikes and kills game?

Abu Al-Khattab holds that it is not permissible because the hunter did not intend to hunt a true game animal. However, another supported view suggests it is permissible because the validity of intention rests upon conjecture (dhann), which was present, thus making the intent valid and the game permissible.
