Book of Hunting and Slaughter

Book 56 · Issue 1 · Bab 1

Open in Qurani

Primary text

If one parent of a person whose slaughter is generally permissible (i.e., a Muslim or People of the Book) is from a lineage whose slaughter is forbidden, then the offspring's hunting and slaughter are forbidden. This view is held by the companions of our school (Ashabuna) and Imam Al-Shafi'i, specifically when the non-People of the Book parent is the father. The prohibition stems from the existence of a factor necessitating prohibition, which overrides the factor necessitating permissibility, similar to the case where a Muslim and a Magian wound an animal.

Supporting text

If the father is a People of the Book, there are two opinions. One opinion permits the slaughter, which is the position of Malik and Abu Thawr. The dissenting opinion holds that it is forbidden because the element causing prohibition outweighs the element causing permissibility.
