Primary text

If the daughter of the maternal uncle (Bint Khāl) and the son of the maternal uncle (Ibn Khālah) are related through the mother only (min umm), the designated portion (one-third) is divided equally between them. If they are related through both parents or the paternal line, there are two narrations regarding the division: whether it is equal or divided into three parts.

Supporting text

If the son of the maternal uncle (Ibn Khālah) is related through the mother only, and the maternal uncle (Khāl) is related through the father only, the son of the maternal uncle receives one-sixth of the one-third portion, and the remainder goes to the daughter of the maternal uncle (Bint Khāl). If the daughter of the maternal uncle (Bint Khāl) is related through the mother only, and the son of the maternal uncle (Ibn Khālah) is related through the father only, the one-third portion is divided among them into four parts, and the remainder goes to the daughter of the paternal cousin (Ibn 'Amm). The majority of commentators rule that the entire estate belongs to the daughter of the paternal cousin because she is the closest heir.
