What is the distribution if daughters of paternal aunts and daughters of maternal aunts replace their parents, assuming the paternal lineage preference holds?
Chapter on Distant Kindred (Dhawu al-Arham)
Al-Mughni
Book of Inheritance Shares (Farā'id)
Primary text
If the paternal lineage preference holds, the exclusion of siblings' children by the maternal cousins (daughters) occurs because the maternal cousins are from the paternal side, which leads to the exclusion of the daughters of the paternal aunts and all sons of paternal uncles by extension.
Supporting text
If the paternal aunts and maternal aunts are replaced by their daughters, the maternal aunts' daughters receive one-sixth divided among them on five shares, and the remainder goes to the siblings' children. The daughter of the maternal brother receives one-sixth, and the remainder goes to the daughter of the paternal brother. The distribution resolves into thirty parts. If there are no siblings' children from both parents or only the father, the remainder goes to the daughter of the full paternal cousin.
