Book of Inheritance Shares (Farā'id)

Book 32 · Issue 4 · Bab 5

Primary text

The entirety of the estate belongs to the daughter of the maternal uncle (bint akh li-umm).

Supporting text

Al-Thawri, Ibn Salim, and Dhirar hold that the daughter of the maternal uncle receives one-sixth, and the remainder is given to the daughter of the paternal uncle, based on the principle that they grant inheritance to the more distant relative alongside the closer relative, even when they share the same lineage side.
