Primary text

When a Khuntha and Asabah are present, the Khuntha receives three-quarters of the estate, and the remainder goes to the Asabah. This applies universally, except under the opinion that distributes claims from the original estate.

Supporting text

Under the opinion distributing claims from the original estate, the division is made into thirds because the Khuntha claims the entire estate, and the Asabah claims half, resulting in a total claim equivalent to three halves, leading to one third for each half.
