Book of Inheritance Shares (Farā'id)

Book 32 · Issue 5 · Bab 2

Primary text

When the mother's mother (Am Um) and the father's father's mother (Um Ab Ab) are present, the entire estate belongs to the mother's mother (Am Um). This is the ruling of Al-Kharqi, except in the narration from Ibn Mas'ud, where the estate is divided between them. For the case of the father's mother (Um Ab), the mother's mother (Um Um), and the grandfather's mother (Um Jadd), the inheritance belongs to the first two by consensus, except for the view of Shurayk and his followers, where it is divided among all three.

Supporting text

In the case of the mother's mother's mother (Um Um Um), the father's father's mother (Um Ab Ab), the father's father's father's mother (Um Ab Ab), and the mother's father's mother (Um Um Ab), the inheritance belongs to the first three according to Ahmad and his followers. However, Abu Hanifa and his followers allocate it to the first four. The remaining four grandmothers in this group (Um Um Ab Um, Um Ab Um Um, Um Ab Ab Um, and Um Ab Um Ab) are veiled except in a rare narration.
