What is the division of inheritance when one possesses a son of a son (grandson)?
Chapter on Distant Kindred (Dhawu al-Arham)
Al-Mughni
Book of Inheritance Shares (Farā'id)
Primary text
The inheritance is divided equally between the two parties by consensus, except according to Al-Thawri. Al-Thawri stated that the son of the son receives one-fourth because he is veiled (mahjub) by half of the son from that quarter share. If the second half of the share belongs to a free person, the son of the son receives the quarter. If there is a son of a son of a son, half of whom is free, that person receives one-eighth.
Supporting text
It is held by some that the higher-ranking heir receives half, and the second heir receives the other half, due to the freedom (hurriyah) present in the second heir. This is the position of Abu Bakr. Sufyan stated that the second and third heirs receive nothing because the portion containing freedom is veiled by the freedom of the son. If a free brother or other residuary male heirs (asabat) are present with them, they receive the remainder.
