How is the estate allocated when parents and two daughters divide the inheritance, and they subsequently acknowledge a daughter of the deceased?
Chapter on Distant Kindred (Dhawu al-Arham)
Al-Mughni
Book of Inheritance Shares (Farā'id)
Primary text
If parents and two daughters divide the estate, and they then acknowledge another daughter of the deceased, and the acknowledged daughter states she has fully received her share, the basis for admission is eighteen shares: six for the parents, and four for each daughter. The share of the acknowledged daughter is removed, leaving fourteen shares. The parents take six shares, which is one-third of fourteen shares (four shares and two-thirds of a share). This leaves one share and one-third remaining in the possession of the two daughters, which they take from her. Multiplying three by fourteen yields forty-two; the parents have taken fourteen, but they are entitled to eighteen, so they take four more from the daughters, leaving the two daughters with twenty-four.
Supporting text
If the acknowledged daughter states she has received half her share, two shares are removed from eighteen, leaving sixteen. They took one-third of sixteen, which is five and one-third, leaving them two-thirds of a share. Multiplying this by three yields eight; they have taken sixteen, leaving them two shares.
