Primary text

If the estate consists only of the daughter of a daughter and the daughter of a son's daughter, the estate is divided into four parts, with two parts going to the daughter of the daughter and one part to the daughter of the son's daughter, leaving the remaining share for the daughter of the brother (if present). If a maternal aunt is present alongside the daughter of a daughter and the daughter of a son's daughter, the daughter of the daughter receives one half, the daughter of the son's daughter receives one sixth (completing two-thirds), and the maternal aunt receives one sixth, with the remainder going to the daughter of the brother. If a paternal aunt replaces the maternal aunt, the paternal aunt inherits the remainder after the first two-thirds are satisfied, excluding the daughter of the brother because the paternal aunt is substituted for the father, who excludes the one substituted for the brother.

Supporting text

According to the view of Ahl al-Tanzil (substitution school), the daughter of a brother inherits nothing if the daughter of a daughter or the daughter of a son's daughter is present. If the paternal aunt is substituted for the grandfather, she shares the remaining third equally with the daughter of the brother. If she is substituted for the grandmother, she receives one sixth, and the daughter of the brother receives the remainder.
