Primary text

The entire estate belongs to his paternal uncle because he is the deceased's direct residuary heir (Asaba). This distribution should be considered universally agreed upon (Ijmā').

Some scholars suggest that the paternal grandfather's paternal uncle might take precedence because he is the paternal uncle of the one who underwent Li'an. This view is clearly erroneous because residuary heirs are judged based on their proximity to the deceased, not based on their relationship to the ancestors who underwent Li'an.
