Primary text

A daughter who is half free is entitled to one-fourth (al-rubʿ) of the estate by fixed share (fard). The remainder (al-bāqī) goes to the residuary heirs ('aṣaba). If no residuary heirs exist, she receives the remaining half by the rule of return (radd), and whatever is left after that goes to the kindred by womb (dhawī al-raḥim). If neither exist, the remainder goes to the public treasury (bayt al-māl).

Supporting text

If a free mother is present with such a daughter, the mother receives one-fourth because the free status of the daughter (even half) blocks the mother from her usual one-sixth share, meaning half of the daughter's status blocks half of the mother's reduction.
