Inheritance status when a man marries a woman during her waiting period (*iddah*) according to their former practices, followed by conversion to Islam.
Chapter on Distant Kindred (Dhawu al-Arham)
Al-Mughni
Book of Inheritance Shares (Farā'id)
Primary text
In the apparent position of the school of Ahmad, if they convert after entering into the marriage during the *iddah*, the marriage is affirmed, and they inherit. This is also the view of Abu Hanifa. The ruling is that if they convert after the *iddah* has concluded, the marriage is affirmed. Consequently, if one dies before the *iddah* ends, they do not inherit; if one dies after the *iddah* ends, they inherit.
Supporting text
Al-Qadi interprets the narration from Ahmad as applying only to the case where they embraced Islam after the completion of the *iddah*. Al-Qadi's view implies that if they convert while the *iddah* is still ongoing, they are not affirmed, and thus do not inherit.
