What is the inheritance status if a sick husband divorces his wife via Li'an after accusing her (Qadhf) during his illness?
Chapter on Distant Kindred (Dhawu al-Arham)
Al-Mughni
Book of Inheritance Shares (Farā'id)
Primary text
If the sick husband accused his wife (Qadhf) and then performed Li'an (mutual imprecation) during his illness, thereby separating from her, and then died during that illness, she inherits from him. If she died, he does not inherit from her.
Supporting text
If he accused her during health and performed Li'an during illness, dying in it, she does not inherit from him. This is the position of Ahmad and Shafi'i, and Al-Lu'lu'i. There is another narration, the position of Abu Yusuf, that she does inherit.
