Al-Mughni
Book of Inheritance Shares (Farā'id)
Primary text
The male heirs are the son, then the son's son however far down. Also inheriting are the father, then the grandfather however far up, the full brother, then the brother's son, the paternal uncle, then the paternal uncle's son, the husband, and the freedman (mawla an-ni'mah). The inheritance of the son is established by the verse: {Allah instructs you concerning your children: for the male, what is equal to the share of two females} [Quran 4:11]. The inheritance of the father is established by {And for his parents, each of them is a sixth of what he leaves} [Quran 4:11]. The brother and sister from the mother have their shares established by {And if he has a brother or sister, then for each of them is a sixth} [Quran 4:12]. The inheritance of the son's son is covered under the general term of 'your children' in the previous verse. The inheritance of the uterine brother and sister is established by the verse concerning the deceased having neither child nor parent {And he inherits it if he has no child, and [if] the father had no heir} [Quran 4:176] (though this verse is specifically cited for the case where parents have no child, it establishes the principle). The inheritance of the brother's son, paternal uncle and his son, and the father's paternal uncle and his son is established by the Prophet's statement, peace be upon him: 'Whatever remains after the fixed shares are given, it belongs to the nearest male relative.' The inheritance of the freedman is established by the saying of the Prophet, peace be upon him: 'Loyalty (al-wala') belongs to the one who frees the slave.'
