Order of priority among the offspring of sisters based on their parentage.
Chapter on Distant Kindred (Dhawu al-Arham)
Al-Mughni
Book of Inheritance Shares (Farā'id)
Primary text
The people of kinship prioritize the offspring from both parents (Abawayn) over all others, then those from the father only, then those from the mother only. Muhammad ibn al-Hasan differs by dividing the inheritance of the offspring of the sisters according to their total number and treating them as if they were the sisters themselves.
Supporting text
An example of this is six daughters from three separate sisters: the wealth is divided among the sisters in five shares, and what each receives goes to her two daughters, solving the case from ten. Abu Yusuf's view is that all wealth goes to the offspring of both parents. Muhammad's view grants two-thirds to them and one-third to the offspring of the mother, solving the case from six.
